Content Monsta Terms of Service

These Terms of Service (“Terms”) govern your use of the services provided by Judge Real Ventures, LLC, operating as Content Monsta. By accessing or using our services, whether on a one-time basis or through a subscription, you agree to these Terms. If there are any other contract agreements in place, those agreements will supersede these standard Terms of Service.

1. Services

Content Monsta provides content production, marketing consultations, and content marketing services. These services may be rendered as one-time services or ongoing subscriptions. Additionally, our services may grant access to third-party software platforms. The specific services offered will be detailed in our communications with you.

2. Account Requirements

To access our services, you may need to create an account. You agree to provide accurate, current, and complete information and to update it as necessary. You are responsible for maintaining the confidentiality of your account and password and for all activities under your account.

3. Use of Services

You agree to use our services responsibly and in compliance with all applicable laws and regulations. Unauthorized or illegal use of our services is strictly prohibited.

4. Third-Party Software Platforms

Our services may provide access to third-party software platforms. By using these platforms, you agree to comply with their respective terms and conditions. Content Monsta is not responsible for the availability, functionality, or performance of these platforms and cannot be held liable for any issues or damages arising from their use.

5. Payment Terms

Fees for services will be specified in our communications with you. Payment is due as outlined, and failure to pay may result in suspension or termination of services.

6. Cancellation and Termination

You may cancel your subscription or one-time service by providing written notice. Content Monsta reserves the right to terminate your access to services for violation of these Terms or non-payment.

Upon cancellation, Customer Content will be kept for up to two months. For privacy reasons, automatic deletion is initiated to remove the content from our servers.

You agree that the Company, at its sole discretion and for any or no reason, may terminate or suspend Your account. You agree that any termination of Your access to the Service may be without prior notice, and You agree that We will not be liable to You or any third party for such termination.

In the event that you cancel a podcast where we maintain the audio hosting, we may continue to host the podcast files at no charge for 30 days after cancellation at which time we have a right to remove the podcast from the podcast host. After that period we have the option to continue free hosting, however, we may insert a Content Monsta brand mention.

7. Use of Customer Name and Logo

By using our services, you grant Content Monsta a non-exclusive, worldwide, royalty-free license to use your name and logo for promotional and marketing purposes, respecting your brand identity.

8. Privacy

We value your privacy and are committed to protecting your personal information. Please review our Privacy Policy for details on how we collect, use, and disclose your information.

9. Customer Content

You retain ownership of any content you submit through our services. You grant Content Monsta a limited license to use, reproduce, and modify your content solely for providing the services.

10. Warranty Disclaimer

Our services are provided “as is” and “as available” without any warranties, express or implied. Content Monsta disclaims all warranties to the fullest extent permitted by law.

11. Limitation of Liability

To the maximum extent permitted by law, Content Monsta shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the services or third-party platforms.

12. Indemnification

You agree to indemnify and hold harmless Content Monsta and its affiliates from any claims, damages, or expenses arising from your use of our services or violation of these Terms.

13. Changes to Terms

Content Monsta reserves the right to modify these Terms at any time. We will notify you of any changes, and your continued use of the services constitutes acceptance of the modified Terms.

14. Refund Policy

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction specified in our communications with you.
